AI in the criminal justice system promises efficiency and objectivity but raises ethical concerns, particularly the risk of reinforcing biases that undermine fairness and justice.
AI tools for predicting recidivism take into consideration a number of factors, including criminal history, demographics, and social circumstances. Even though tools are made to be objective, the data which trains these AI tools may hold biases within themselves. For example, if historical law enforcement practices were biased, AI tools would likely produce flawed reoffending predictions.
A biased AI projection can cause inmates to face harsher sentences, fewer chances of parole, and rehabilitation opportunities. Under the Sentencing Reform Act of 1984, this system emphasizes structured sentencing, but it has to balance the risk assessment of the case while ensuring that every case is not judged unfairly.
Additionally, if AI fails to make accurate risk judgments, it could conflict with the law's focus on individualized sentencing and violate principles established in Furman v. Georgia (1972), where the U.S. Supreme Court ruled that arbitrary sentencing constitutes cruel and unusual punishment.
Most AI algorithms lack transparency, and it is tricky to understand how the algorithms make their decisions. This "Black Box" problem inhibits accountability and scrutiny, violating fair trial rights as provided by Gideon v. Wainwright (1963), in which the Supreme Court guaranteed criminal defendants the right to legal counsel. Without clarity in AI decision-making processes, challenging unfair outcomes becomes significantly more difficult.
